Pre-hearing set for Clearview Township’s challenge of NEC decision

A pre-hearing will take place in March as Clearview Township officials challenge a decision by the Niagara Escarpment Commission to deny a permit to rebuild the 26-27 Sideroad.

The NEC board decided in November not to grant the township’s application, which is part of an overall plan to upgrade the road network around County Road 91. The 26-27 Sideroad is currently considered a ‘summer’ road, and upgrading it to a road that can be used year-round is part of the agreement that allowed Walker Aggregates to expand its quarry operations on County Road 91 west of Duntroon. That agreement would also see County Road 91 handed over to Walker and closed to through traffic west of the 10th Line, and the 10th Line and the 26-27 Sideroad upgraded to handle additional traffic. The agreement also required Walker to pay for upgrades to County Road 91 leading into Duntroon.

Township CAO Stephen Sage said a pre-hearing will determine what parties have status at a hearing as well as determine the scope of the issues at play.

He anticipated the actual hearing to take place in early May, and that it would likely last five days.
