The Niagara Escarpment Commission has sought a judicial review (JR) of the June 2012  joint board decision to approve the new Walker Quarry.  
The Clearview Community Coalition will appear at the JR to support the arguments of the Niagara Escarpment Commission (NEC) and to address the incorrect application of the principles of the Provincial Environmental Assessment Act in assessing the impact of the trucks on the community.

(We hope you can attend.  Be sure to arrive early to allow time to pass through security and to get settled in the court room before the hearing begins.)
Location:              Court Room 3, Osgoode Hall, 130 Queen St. W., Toronto
 Both the NEC and CCC will  request that the Divisional Court quash the joint board decision on the basis that the OMB members made errors in law.  Walker Industries will oppose the application and will pay the legal costs for Clearview Township’s solicitor to represent Clearview Township and Simcoe County in opposition to the NEC and CCC.       
In the words of Mr. Wright, the Environmental Review Tribunal member who wrote the 100 page dissenting opinion, approval of the Walker Quarry, “Sets a perilous course for increased development in the NEP area …”.   The NEC and CCC encourage you to attend the one-day judicial review hearing at Divisional Court, Osgoode Hall, Toronto. This is a very important test case for future development on the Niagara Escarpment, and all who want to see the Escarpment receive the standard of protection that it deserves should be sure to attend, and bring a friend.
