A residential developer will have to wait to find out whether it can start cutting trees before the birds return for the spring.

Fernbrook Homes has draft approval to build 75 units at its Golfview Estates property, just off Golf Course Road in Wasaga Beach’s east end.

At council’s Jan. 26 meeting, Fernbrook planner Darren Vella requested the developer be allowed to start clearing trees ahead of the project getting its final approvals to start construction, which he said is expected to begin later this year.

Under the Migratory Birds Convention Act, tree clearing cannot take place between April 1 and Aug. 31.

The municipality’s process is to grant a tree-clearing permit after final approval of a development.

Director of planning and economic initiatives Doug Herron said the developer is caught in a paradox, as trees need to be removed for geotechnical work in advance of preparations for grading.
