Terry Northey, Elmvale’s Cheese Guy, has sent up a blogspot to assist individuals and businesses affected financially from the two back-to-backroad construction projects on Hwy # 27 ( Yonge St South and North .Elmvale Ontario ) last summer.

He advises:

In recent decades municipalities and construction groups throughout North America have come to recognize that some PPP’s Private Public Projects do cause hardship to local individuals and business for many different reasons.

The Ontario Municipal Board ( now LPAT) have also recognized this fact in recent years.

Under the Ontario Expropriations Act there is a section that deals with losses due to construction. It is the second of 3 parts to the expropriations act.

The expropriations act will remain unchanged as the OMB transitions fully to the more locally controlled LPAT

Appeals can be submitted to LPAT (OMB) individually or as a group.The group approach actually seems to be preferred by the OMB. There is also safety in numbers. All privacy regulations apply.

There is a 1 year capture time limit to file. It would appear that the OMB route is the only way to be compensated from Public Private Project losses. There is a reply email on this dedicated Blog. Plus a separate phone # with Voice messaging.
