Notice of Requested Allocation 20,000 Population Program – Town of Wasaga Beach and Town of Innisfil

Issued: November 1, 2016

TAKE NOTICE that a Request for population allocation within the County of Simcoe 20,000 population program has been received by:

-Wasaga Dunes Resort Inc.
-2355573 Ontario Inc.
-2081788 Ontario Corporation

Related Town of Wasaga Beach Official Plan Amendment Files No. 43, 44, 45 and Town of Innisfil Official Plan Amendment File No. 19.

A copy of the Request has been posted to the County of Simcoe website (simcoe.ca).

You are receiving this notice because you have requested to be notified upon receipt of a Request by the County of Simcoe, or you requested notice or made written or oral submissions during an application process with a lower tier municipality in the County of Simcoe.

Council Committee of the Whole is scheduled for November 8, 2016, at which time a staff report regarding the Request will be introduced, without debate. An approval hearing by County Council on the requests will be held on November 22, 2016 at 11:00am where deliberations, presentations and a decision will be made regarding the requests.

Applicants (or their agents) requesting a portion of the 20,000 population, or any particular person, or group of persons, or representative of a corporation or association may be heard at the hearing provided that the request to be heard and a detailed outline of the proposed verbal presentation is provided to the County Clerk within 10 days of the date of this notice.

Any particular person, or group of persons, or representative of a corporation or association may provide a written submission to the hearing if a written submission is received within 10 days of the date of this notice.

Upon receipt of a written request, an Applicant has a right to:

-make a presentation to County Council supporting their Request;
-present evidence in support of their request; and
-have counsel assist with their deputation.

Following the giving of evidence and presentations by the applicant and those in favour of the proposal, those wishing to oppose the request shall be permitted to make a presentation. Following the evidence of those in opposition to the presentation, the Applicant shall be permitted to reply to the evidence in opposition.

AND FURTHER the Warden, on the motion of Council and on a vote by a majority of the members of Council in attendance, may refuse to hear any particular person, or group of persons, or representative of a corporation or association other than the Applicant who Council, in their discretion determines do not represent a legitimate interest in the request being considered;

The Warden, on the motion of Council and on a vote by a majority of the members of Council in attendance may limit the length of any of the presentations in favour or in opposition to the request, including that of the Applicant;

The Warden further, on the motion of Council and on a vote by a majority of the members of Council in attendance, may refuse to hear any evidence, including evidence proposed to be submitted by the Applicant if Council in its discretion feels that the proposed evidence is irrelevant or unnecessarily repeats evidence of another witness or presenter;

AND FURTHER all information is collected in accordance with the Planning Act, R.S.O. 1990, CHAPTER P.13, and Municipal Act, 2001, s.8, and for Council’s purposes under s.239(1) and may be used in Council deliberations, and disclosed in full, including email, names, opinions and addresses to other persons requesting access to records, or as part of a public agenda. All information submitted to the County is subject to the Municipal Freedom of Information Act (MFIPPA).
