OMB “parks decision” on whether it has jurisdiction in Midhurst issue

The Ontario Municipal Board has released a ruling on the County of Simcoe’s motion that the board does not have jurisdiction to overrule county council’s decision not to grant any Chiarelli population allocations to some major Midhurst landowners

-OMB panellist Chris Conti told the parties in a telephone conference call August 23 that he may or may not have jurisdiction so he is “parking the decision.”
-He will go ahead and hold a hearing September 19 anyway (clarification being sought on the scope of the hearing, more details to come). UPDATE: the hearing is apparently set for Wednesday October 5.
-“Due to some misunderstanding and oversight counsel for all parties did not participate in the August 23 TCC,” Conti writes. He does not state which parties were left out of the conference call.
