Burl’s Creek Files Appeal with the Ontario Municipal Board

Oro-Medonte Council had a Special Council meeting scheduled for October 21st to receive the staff report regarding the 2015 Temporary Use By-law application for Burl’s Creek Event Grounds. The Township has now received an appeal filed by Burl’s Creek for the Ontario Municipal Board (OMB) on the failure of the Township to make a decision.

Now that an appeal has been filed, the decision on the 2015 TUB application rests with the OMB, and not with Oro-Medonte Council. As such, the Township no longer has jurisdiction regarding this issue. The October 21st Special Council meeting has been cancelled.

An appeal may be filed with the OMB within 120 days from the date when the application is deemed complete. The Township deemed the application complete on April 13, 2015. There are a number of factors involved in the process before a staff report may be prepared. The complexity and changes to technical studies associated with the application, including the timing of responses from external agencies are a few of the factors that impacted the status of completing the staff report.

Township staff are currently preparing the package of the required documentation to be sent to the OMB. Appeals can be made to the OMB under various legislation, including the Planning Act. Once an appeal has been processed, details including hearing date and location, will be available on the E-Status section of the OMB website. The second matter that was scheduled for the October 21st meeting dealing with the proposed general amendments to the Zoning By-law (2015-ZBA-09) will now be presented on November 4th during the Development Services Committee meeting. The agenda and staff report will be posted to the Township’s website on November 2nd. As previously indicated, this proposed amendment does not apply to the Burl’s Creek lands.
