Legal concerns surround Midland’s purchase of former Unimin property

Town will be on the hook for any lawsuits related to site

MIDLAND – The Town of Midland has officially approved the purchase of the former Unimin property for $3.4 million, but some councillors are concerned the agreement leaves the town vulnerable to lawsuits.

The purchase agreement was approved in a 6-3 vote during a special council meeting June 12. It states the town is now responsible if anyone comes forward with a lawsuit related to the 16-hectare property – no matter if their complaint originated from yesterday or decades ago.

Deputy Mayor Stephan Kramp said he is concerned about the financial risks related to the Bayshore Drive property.

“We have to accept the will of council, but we should give this some thought. I have very, very serious concerns,” he said, adding a massive lawsuit could affect the future of Midland and its residents.
