CMC indemnity issue remains unresolved

It’s been some time since members of the Site 41 Community Monitoring Committee first asked whether they were covered by the indemnity bylaw that protects Simcoe County councillors and staff from liability for decisions taken. The County amended its bylaw to include them in 2005, but an opinion from Countyy solicitors Graham, Wilson and Green advised CMC members to obtain waivers if they anticipated any foreseeable risk to any individuals as a consequence of the committee’s actions.
The CMC asked for clarification, most recently at its November 12 meeting and a staff report to the County’s corporate services committee today recommended that GWG be asked to provide clarification
That didn’t sit well with councillors. Adjala-Tosorontio Deputy Mayor Doug Little asked how much the legal opinion would cost and was told it would be in the $2,000-$5,000 range.
 “Why do we need a CMC?” Little questioned, noting that council decided to cancel the dump site. “I don’t understand what CMC members think they’re going to be doing.”
Tiny Deputy Mayor George Lawrence pointed out that the CMC is a requirement of the Site 41 Certificate of Approval, and as long as that is in place, there will be a CMC.
“It’s not a landfill any more so enough already,” said Clearview Mayor Ken Ferguson, proposing that the matter be sent back to the CMC for further consideration.
“Send it back to the CMC,” Little agreed, adding, “I know what they’re going to come back with, they’re going to ask the County to spend more money.”
Special meeting of council on waste strategy
A special meeting of council has been called for January 28 to discuss the waste strategy. In response to questions from George Lawrence, Environmental Services Director Rob McCullough explained that what is planned is a workshop, and for council to make some decisions about moving forward, such as the format of public information sessions.
No comment on Aileen Carroll letter
Committee members made no comment on the content of a letter from Barrie MPP Aileen Carroll suggesting that Simcoe County ask the province to revoke the Site 41 certificate of approval. The letter was received for information. It’s not clear whether the response she requested will be forthcoming.
